Terms of Service

These Terms of Service ("Terms") govern your access to and use of KuvarPay’s crypto-based payments platform, dashboard, APIs, and related services (collectively, the "Services"). By using the Services, you agree to be bound by these Terms.

Eligibility and Registration

• You must be at least 18 years old and have the legal capacity to enter into contracts.
• Businesses must provide accurate registration details and comply with applicable laws and regulations.
• We may require KYC/KYB verification and sanctions screening before granting or continuing access.

Use of Services

• Accept crypto payments through supported assets and networks as made available in your dashboard.
• Use APIs and integrations in compliance with documentation, rate limits, and security requirements.
• Do not engage in prohibited activities including fraud, money laundering, terrorist financing, market manipulation, sanctions evasion, or any unlawful conduct.
• Maintain the security of your account credentials, enable two-factor authentication, and promptly notify us of suspected unauthorized access.

Compliance and Risk

You acknowledge that digital asset transactions can be volatile and may be subject to regulatory changes. We perform risk assessments and may impose limits, delays, holds, or require additional information to satisfy compliance obligations (AML/CFT, sanctions, fraud prevention).

Fees and Settlements

• Fees are disclosed in your dashboard and may vary by asset, network, geography, and usage.
• Settlements may occur on-chain or to designated payout accounts as configured by you.
• Network fees, exchange rates, and blockchain confirmations can impact timing and amounts.

Intellectual Property

The Services, including software, documentation, and branding, are owned by KuvarPay or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms. You may not reverse engineer, copy, or create derivative works except as permitted by law.

Warranties and Disclaimers

The Services are provided "as is" and "as available". We disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

Limitation of Liability

To the maximum extent permitted by law, KuvarPay shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or revenue, arising from your use of the Services. Our total liability for any claim shall not exceed the fees paid to us in the twelve (12) months preceding the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless KuvarPay, its affiliates, officers, and employees from and against claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or in any way connected with your use of the Services or violation of these Terms.

Suspension and Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, engaged in prohibited activity, or for compliance reasons. You may stop using the Services at any time. Certain obligations survive termination.

Changes to the Services and to these Terms

We may update the Services and these Terms from time to time. If changes are material, we will provide reasonable notice via the dashboard or email. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

Governing Law and Dispute Resolution

These Terms are governed by applicable laws of the jurisdiction in which KuvarPay operates. Disputes shall be resolved through good-faith negotiations; if unresolved, they may be brought before competent courts. Where permitted, the parties waive class actions.
